Warranty and Terms
GENERAL TERMS
K&S and Greenday, Inc . agrees to provide all labor, equipment, tools and furnish all materials required to complete the work outlined in the proposal. All extra work requested shall be paid the day of completion. Proposal provided is an estimate of the expected costs for completing the project. Prices are subject to change due to availability.
K&S and Greenday is at all times looking for the most professional design for your home as well as the safest and most practical use of your hardscaping area.
All work shall be completed in a workmanlike manner. Design photos, drawings and details will serve as guidelines. Plant substitutions may be necessary due to availability. Due to site conditions, minor variations to landscape drawing may be made on-site by landscape designer.
Transplanted material is not guaranteed.
This proposal is subject to extra charges for concealed contingencies (i.e. rock, debris, poor drainage situations, etc.) not readily apparent in estimating materials and labor specified.
Location of all property lines and corners shall be the responsibility of the owner. K&S and Greenday is not responsible for any damages to underground improvements arising from excavation on owner’s property (i.e. irrigation systems, drainage, invisible dog fences, electric lines, etc.).
All zoning, building and construction permits necessary shall be the responsibility of the owner. K&S and Greenday cannot initiate work until permits are obtained. K&S and Greenday will assist the owner in filing applications for necessary permits. All fees involved will be the sole responsibility of the property owner.
Contractor will not be responsible for damages arising from excavating and striking of any improperly marked underground utilities of any sort, including but not limited to: phone, electric or cable lines, gas, water or sewer lines. K&S and Greenday will contact PA One Call System or NJ One Call System one week prior to excavating.
Owner will carry appropriate homeowner’s insurance. K&S and Greenday will provide Worker’s Compensation and General Liability Insurance on above work.
PLANTING GUARANTEE:K&S and Greenday will replace any plants which fail to survive, one time, for a period of one year after date of invoice, provided that account is paid in full, plants receive normal and customary maintenance and report of loss is made promptly. Plants will be replaced during the next planting season. Regular charges may be made for delivery and planting. Substitutions may be necessary based on availability. This guarantee does not apply to bedding plants, sod or plant material that has been supplied by owner or transplanted on owner’s property. K&S and Greenday cannot guarantee germination of grass seed or offer a warranty on our hydro-seeding as there are too many variables involved, over which the contractor has no control. Any damages from neglect, animals, vandals, Acts of God, drought, township or state watering restrictions or other conditions beyond the control of contractor voids guarantee. All warranty issues need to be in writing.
HARDSCAPING TERMS
Any hardscaping contract signed from viewing of digital photos or CAD drawings is subject to minor changes at K&S and Greenday’s discretion. Digital designs and CADs do not always show accurate depth and rises. K&S and Greenday reserves the right to make changes on step elevations, designs and landing sizes to secure safety and township code issues and to ensure our ability to offer our lifetime warranty. There will be no changes in colors or brick.
Minor weathering, color variations, flaking and imperfections in masonry products and natural stone are considered normal for these products and are not covered under guarantee.
Minor “checking” of wood products is considered normal and not covered under guarantee.
All hardscaping materials and selections (i.e. style, color, etc.) will be approved by the owner and the landscape designer prior to initiation of work.
HARDSCAPING GUARANTEE: K&S and Greenday provides a 10 year guarantee on the workmanship of all hardscaping. K&S and Greenday will make all necessary adjustments needed due to settling or loosening. Scope of work will include adjustments to newly installed hardscaping only. Any damages from animals, vandals, Acts of God, improper use or other conditions beyond the control of contractor voids guarantee. All warranty claims should be directed to K&S and Greenday in writing. The lifetime product guarantee is provided by the manufacturer and any warranty issues pertaining to the product should be directed to EP Henry.
